You have a right to fair treatment at your job

Under Texas law, employers commit an unlawful employment practice if they fire, refuse to hire or in any other way discriminate against someone based on:

Employers violate the law if they use any of those characteristics to limit, segregate or classify an employee or applicant in a manner that would deprive that person of any employment opportunity.

An employer cannot retaliate against you for lawful behavior

Employers cannot retaliate against employees for filing a claim for workers compensation. Texas law guarantees you the right to file a claim for your injuries without fear of reprisal.

Similarly, people who exercise other protected rights in the workplace cannot be mistreated by their employer in response. Protected rights include:

  • Opposing a discriminatory practice
  • Making a charge
  • Filing a complaint
  • Testifying, assisting or participating in an investigation or hearing

You also can refuse to perform a task that puts you, your coworkers or the general public in danger. Employees who alert authorities or comply with the requests of investigators are also protected under whistleblower laws.

Protecting you from harassment and abuse

Sexual harassment can take a number of forms, including unwelcome advances, requests for sexual favors, or physical touching that is sexual in nature from a coworker or supervisor. As well, suggestive comments and off-color jokes can impede your ability to work, creating what is known as a hostile work environment. A manager or business that is aware or should be aware of such behavior and fails to take action may be liable to you for damages.
