How To Appeal A Social Security Disability Denial in Texas
Once you file your application for social security disability benefits, it usually takes 30 to 90 days to get a decision. Most people get denied benefits at this level, even with very significant disabilities.
Request For Reconsideration
Once the denial comes in the mail, you only have 60 days to take action and file an appeal. In most states, including Texas, the first appeal is called a request for reconsideration. It’s just a form you fill out – Form 561, and it can be filled out online at ssa.gov. Once filed, a different team reviews your application for benefits. And again, most people get denied at this level.
Request For Social Security Hearing
If your request for reconsideration is denied, the next step is to request a hearing. Again, you only have 60 days to do this, and it can be done online. You will need to file Form 501. At this point, it will take many months before you hear back from the SSA with a date for your hearing.
Here’s a tip: once you file the request for hearing, call the SSA and confirm that they received it. If it ever gets lost, you might have to start all over.
If you want help with this process, you can hire an attorney to do it all for you. It shouldn’t cost you anything unless and until you are awarded benefits.
